TERMS OF SERVICE

These Terms of Service govern your use of the Koguma Patisserie website and any purchase made through it.

This website is operated by J & Co Sydney Pty Ltd (ABN 89 602 950 827), trading as Koguma Patisserie, referred to in these terms as “Koguma”, “we”, “us” or “our”.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service and our applicable policies.

USE OF OUR WEBSITE

You agree to use the Koguma website only for lawful purposes and in a way that does not interfere with its operation, security or availability.

You must not:

  • Use the website for fraudulent, unlawful or unauthorised purposes.
  • Submit false, misleading or incomplete information.
  • Attempt to interfere with the website, checkout or payment systems.
  • Upload malicious code or content.
  • Copy, reproduce or commercially exploit website content without permission.

ACCOUNTS AND CUSTOMER INFORMATION

You are responsible for ensuring that your account, contact, billing and delivery information is accurate and current.

You are also responsible for maintaining the confidentiality of your account details and for activity conducted through your account.

PRODUCTS AND AVAILABILITY

All products are subject to availability. Koguma may modify, replace or discontinue a product where reasonably necessary.

Our cakes and other products are handmade. Minor differences in colour, decoration, finish, size or presentation may occur and do not necessarily indicate a defect.

Colours may also appear differently depending on the customer’s screen and device settings.

PRICES, GST AND CHARGES

All prices displayed on the Koguma website are in Australian dollars and include GST unless otherwise stated.

Prices may change without notice due to changes in ingredient costs, seasonal availability, government taxes, duties, charges or levies.

Applicable delivery fees, weekend surcharges or optional charges will be displayed or communicated before the order is finalised.

ORDERS AND PAYMENT

Submitting an order does not guarantee acceptance. An order is confirmed once Koguma accepts it and provides confirmation by email or another agreed method.

Orders require full payment unless Koguma has approved alternative payment arrangements for a corporate account.

Koguma may decline or cancel an order where:

  • The requested product is unavailable.
  • The requested delivery date or special requirement cannot be accommodated.
  • The delivery address is outside Koguma’s service area.
  • Payment has not been received.
  • The order information is incomplete or incorrect.
  • The order is suspected to be fraudulent.

CUSTOMER INSTRUCTIONS

Customers are responsible for providing complete and accurate order, contact and delivery information.

Koguma is not responsible for delays, failed deliveries or additional costs caused by incorrect information or instructions supplied by the customer.

DIETARY REQUIREMENTS AND ALLERGENS

Koguma products may contain or come into contact with common allergens, including dairy, eggs, wheat, gluten, soybeans, tree nuts, peanuts, fish and shellfish.

Dietary requirements must be provided in writing before delivery and are not confirmed until Koguma has accepted them.

Although reasonable care is taken, Koguma cannot guarantee that any product is completely free from allergens or cross-contamination.

INTELLECTUAL PROPERTY

All website content, including text, photographs, graphics, branding, product names and designs, is owned by or licensed to Koguma and is protected by applicable intellectual-property laws.

Content must not be copied, reproduced, modified, distributed or used commercially without prior written permission.

CIRCUMSTANCES BEYOND KOGUMA’S CONTROL

Koguma will not be responsible for a delay or failure to fulfil an order caused by circumstances beyond its reasonable control, including severe weather, road closures, emergencies, supplier disruptions, power failures, government restrictions or other unforeseen events.

Where reasonably possible, Koguma will contact the customer and offer an appropriate alternative, replacement, store credit or refund.

TERMINATION

Koguma reserves the right to cancel an order or delivery if:

  • The order cannot be fulfilled due to circumstances beyond Koguma’s reasonable control.
  • The delivery address is outside Koguma’s service area or delivery cannot be completed safely.
  • The customer has provided incomplete or incorrect information.
  • Full payment has not been received by the required time.
  • The requested product, date or special requirement cannot be accommodated.
  • The order is suspected to be fraudulent or breaches these terms.

If Koguma cancels an order, we will contact the customer as soon as reasonably possible. Where appropriate, customers may be offered an alternative delivery date, replacement product, store credit or refund.

LIMITATION OF RESPONSIBILITY

Once an order has been delivered according to the customer’s instructions, including being left in an authorised safe place, Koguma is not responsible for loss, theft, damage, deterioration or spoilage occurring after delivery.

To the extent permitted by law, Koguma is not responsible for indirect or consequential loss arising from the use of our website, products or services.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law.

THIRD-PARTY SERVICES

Our website may contain links to or use services provided by third parties. Koguma is not responsible for the content, availability or practices of third-party websites and services.

CHANGES TO THESE TERMS

Koguma may update these Terms of Service to reflect changes to our business, website, products or legal obligations.

The updated terms will be published on our website with a revised “Last updated” date.

JURISDICTION

These Terms of Service and any contract to which they apply are governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of the courts of New South Wales.
